Carson Messinger's broad-based experience in real estate and related matters allows us to advise you in all phases of a complex commercial real estate project, including:

  • Acquisition and disposition. We regularly represent corporate, institutional and individual investors and developers in the acquisition and sale of commercial, industrial and residential subdivisions and multi-family residential properties. We work closely with clients and consultants in analyzing properties and addressing issues that arise in connection with real estate transactions.

  • Development. Carson Messinger's attorneys represent large and small developers in the development, subdivision and construction of projects located throughout the Southwest and elsewhere. Office buildings, office parks, shopping centers, industrial projects, residential subdivisions, mixed-use and re-use developments, and multi-family rental housing are just a few examples of the kinds of projects where Carson Messinger's experience and familiarity with local, state and federal regulatory issues have made important contributions to the success of our clients.

  • Financing. We represent regional and national banking institutions, pension funds, insurance companies and other financial institutions in a variety of financing and credit arrangements. We also represent borrowers, including individuals, partnerships, corporations, LLCs and non-profit institutions. Carson Messinger can assist in structuring complex loan participation, construction loans, and publicly subsidized financing as well as more conventional financing.

  • Leasing. Carson Messinger's commercial leasing practice extends from routine leases of office and retail space to complex office, industrial and shopping center leases. We monitor the latest legal and market developments to help ensure the highest quality representation for commercial landlords and tenants.

  • Workout and foreclosure. We handle numerous loan foreclosures for both commercial and residential properties. Our clients include private investors, public banks and private financial institutions. Along with prosecuting mortgage foreclosures for our clients, we track the foreclosure process all the way to the public auction to protect our clients' financial interests. In the course of these matters, Carson Messinger regularly advises clients on lender liability issues and environmental and bankruptcy concerns.

  • Real estate litigation. Carson Messinger offers seasoned experience in litigating real estate disputes involving a broad range of issues, including: adverse possession and prescriptive easements; purchase and sale contracts; commercial leases; design and construction defects; property tax assessments; eminent domain; broker liability; prosecuting and defending eviction actions; lender liability; title insurance and escrow liability; boundary disputes; and easements.
